General Terms and Conditions – Mochi Catering

General

These ‘General Terms and Conditions’ apply exclusively to all transactions between the client and Mochi Production GmbH in the ‘Catering’ business segment.

Should orders in written form contain other conditions, the signed order confirmations shall apply as the basis, otherwise the General Terms and Conditions shall apply exclusively.

ASSORTMENT

The food and drinks listed in our offers are subject to change. Our extensive range is always subject to seasonal changes. If individual products are temporarily unavailable, we reserve the right to replace them with goods of at least equal value.

RANGE OF SERVICES & ORDERING

Unless otherwise agreed, all offers and other documents remain the property of Mochi Production GmbH with all rights. Any other utilisation in any form is prohibited, in particular reproduction and distribution or disclosure to third parties as well as making changes without the express consent of Mochi Production GmbH.

It goes without saying that our offers are to be regarded as proposals, which we are happy to adapt on the basis of customer requirements.

The order is concluded with the written confirmation of the offer by the client.

When ordering the offer, the client must provide the exact delivery and billing address, including VAT number, as well as a contact person and their availability.

GUARANTEE & NUMBER OF PARTICIPANTS

The final number of participants in an event must be notified to Mochi Production GmbH no later than 72 hours before the start of the event, otherwise the number of people originally ordered will be accepted as the guaranteed number.

Invoicing shall always be based on actual consumption according to our records, but at least on the basis of the guaranteed numbers communicated in writing.

DELIVERY & SERVICE PROVISION

Agreed deadlines shall be met by Mochi Production GmbH provided that normal operations are maintained. Strikes, cases of force majeure, operational disruptions of any kind shall release Mochi Production GmbH from the obligations assumed.

PRICES

All prices and price quotations are exclusive of VAT and are quoted in EURO, even if not expressly designated as such, and do not include any ancillary public charges.

The offer prices are valid for one month from the date of the offer. After expiry of this period, Mochi Production GmbH is authorised to pass on the price increases of the manufacturers or suppliers and the wage increases according to the valid collective agreements to the Client. The Client may withdraw from the contract if the price is more than 10% higher than the price at the time of conclusion of the contract.

If there is a period of more than one year between the conclusion of the contract and the start of the event, all services shown in the cost estimate shall be value-assured on the basis of a percentage of 4.5% or the CPI 2020 (the higher percentage shall be applied).

VALUE ADJUSTMENT

CANCELLATION TERMS

A written cancellation of the catering order by the client is:

– Up to 10 days before the event -> free of charge
– Up to 7 days before the event -> 25% of the order amount will be charged
– Up to 3 days before the event -> 75% of the order amount will be charged

In the event of cancellation within 3 days before the event, Mochi Production GmbH is entitled to charge the full anticipated order amount.

TERMS OF PAYMENT

Once the final invoice has been issued, the balance is due within 10 days. In the event of late payment, 10% interest on arrears of the invoice amount per month and any reminder fees shall be due.

AUTHORITIES & INSURANCE

The client is responsible for all official authorisations and requirements as well as the conclusion of any insurance policies; Mochi Production GmbH is covered by liability insurance.
